Custody
and Access Assessments
Custody
and access assessments may be required to assist a family in developing
plans for their children that best meet their childrend's needs.
Custody and acces assessments can be ordered by the court or they can
be completed on the
consent of the parties.
What
is the process of a Custody and Access Assessment?
The custody assessor or family mediator will meet individually with the
parents, the children and
other significant parties. In most cases, the parents attend for three
or four meetings. The assessor will observe each of the parents in a
home (or other agreed upon) environment with their children. Contact
may also be made with other professionals who have been involved with
the family (such as teacher, family doctor, or counsellor) and
additional information will be sought out as is required to complete
the custody and access assessment.
The custody assessor will make recommendations with respect to a
custody and access plan for the
children that the custody assessor feels best meets the needs of the
children.
In most situations, an custody assessment report is prepared. A custody
and access assessment,
with a report, involves approximately 30 to 40 hours and may take 2 to
4
months to complete.
What
is the cost of a Custody and Access Assessment?
A retainer is typically requested prior to the custody and access
assessment taking place.
Unless otherwise agreed, the parties share the cost equally. The hourly
rate of $200 per hour is charged by the Mediation Centre. In more
complex situations or when extensive travel is required, an additional
retainer may be requested. An accounting will be provided upon the
completion of the assessment and any balance will be refunded at that
time.
Should the custody and access assessor be required to give evidence in
court, a court
attendance fee of $800 per half day at court plus preparation time at
the rate of $200 per hour will be charged.
A
limited number of custody and access assessments at Legal Aid Rates
will be accepted.
